By completing your purchase, you (“Participant”) agree to the following terms with DanDanTheFireman LLC, dba Motorcycle Training Concepts (“Provider”):

1. Educational Use Only – The SMART Rider Training Manual and related content are provided for educational purposes. No guarantee of safety, licensing success, or specific results is made.

2. Assumption of Risk – Motorcycling is inherently dangerous. Participant accepts full responsibility for all risks, including property damage, injury, or death, arising from use of these materials.

3. Compliance with Laws – Participant is solely responsible for following all federal, state, and local motorcycle laws, licensing requirements, and safety regulations.

4. Protective Gear – Participant agrees to always wear, at minimum, a DOT-approved full-face helmet, gloves, long pants, long-sleeve shirt or jacket, and above-the-ankle footwear when practicing.

5. Personal Motorcycle – If using a personal motorcycle, Participant is solely responsible for its safe condition and insurance.

6. Release of Liability – Participant releases and holds harmless the Provider and its owners, officers, employees, and agents from any claims, damages, or liabilities, including those caused by negligence.

7. Indemnification – Participant agrees to defend and indemnify the Provider against claims brought by third parties arising from Participant’s use of the materials.

8. Binding Arbitration – Any dispute shall be resolved exclusively by binding arbitration under the AAA Consumer Arbitration Rules in Pima County, Arizona. Participant waives the right to jury trial and class action.

9. No Refunds After Access – Once digital course access is provided, purchases are final and non-refundable.

10. Entire Agreement – These Terms form the entire agreement between Participant and Provider regarding this purchase.
